By accessing or using any services provided by Sterling Path LLC ("we," "us," "our"), including our website at sterlingpathllc.com, our online store, WordPress plugins, hosted email services, email marketing platform, and cloud file storage, you agree to be bound by these Terms and Conditions. Certain services require you to create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to provide accurate, current, and complete information during registration and to update such information as necessary.
We reserve the right to suspend or terminate accounts that violate these terms or that we reasonably believe are being used for unauthorized purposes.
All purchases through our store are processed via encrypted communications between our shop and our credit card processor. We do not store credit card data. Prices are listed in US dollars. You agree to pay all charges associated with your purchases, including applicable taxes.
Subscription services (hosted email, email marketing, file storage) are billed on a recurring basis. You may cancel your subscription at any time with no cancellation fees. Upon cancellation, your service will remain active through the end of your current billing period.
All software, code, designs, content, and materials provided by Sterling Path LLC are proprietary and protected by applicable intellectual property laws. Our WordPress plugins are licensed, not sold. Each plugin license is valid for a single domain unless otherwise specified at the time of purchase.
You may not redistribute, resell, sublicense, reverse engineer, decompile, or create derivative works from any of our software products. All rights not expressly granted are reserved by Sterling Path LLC.
You agree to use our services only for lawful purposes and in accordance with these terms. You shall not:
To the maximum extent permitted by law, Sterling Path LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of our services, including but not limited to loss of profits, data, or business opportunities.
Our total liability for any claim arising from these terms or your use of our services shall not exceed the amount you paid to us in the twelve (12) months preceding the claim.
You agree to indemnify, defend, and hold harmless Sterling Path LLC, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to your use of our services, your violation of these terms, or your violation of any third-party rights.
We strive to maintain high availability for all services but do not guarantee uninterrupted access. We may perform scheduled maintenance with reasonable notice. We are not liable for service interruptions caused by circumstances beyond our reasonable control.
Either party may terminate the relationship at any time. You may cancel your account by contacting us at support@sterlingpathllc.com. We may suspend or terminate your access if you violate these terms, with or without notice depending on the severity of the violation.
Upon termination, your right to use our services ceases immediately. We will retain your data for up to 90 days following termination to allow for retrieval, after which it may be permanently deleted.
These Terms and Conditions shall be governed by and construed in accordance with the laws of the State of Florida, United States, without regard to its conflict of law provisions. Any disputes arising under these terms shall be resolved in the courts of the State of Florida.
We reserve the right to update these terms at any time. Changes will be posted on this page with an updated effective date. Your continued use of our services after changes are posted constitutes acceptance of the revised terms.
